Is this illegal and what are our options regarding software piracy?

More details to this question:
We own a restaurant software program that was installed on a POS system that was sold. The requirement was that the software program needed to be transferred to the new owners before use and pay a transfer fee. The new owners have decided not to pay the transfer fee and are currently using our program with our business name and old phone number. They also included their name on all printed receipts. Our requests for transfer have been ignored!

Sounds like you might have a breach of contract with the old and/or new owners. You need to have a lawyer examine the contract. Perhaps, if there is a case, he can file for an injunction against the software being used.
