It could be a trespass as you are coming onto their property to do something you are not permitted to do. You need to check OR law and the local zoning ordinance. It may be interesting to take such a case up to the OR appellate courts. However, this would involve time and expensive lawyer fees. You just may want to put your garbage in your own receptacle.
