QUESTION

Kids Party

Asked on Dec 21st, 2013 on Criminal Law - Virginia
More details to this question:
My 20 year old son invited 90 friends to a party which is to be held in our barn. I am sure not all 90 kids will show up, but if the police are called because of noise , can they come on the property and go in to the barn? what if they just drive by and see lights and a lot of cars? Can they come on the property? If kids bring alcohol and they are caught with it, will my husband and I be charged? If they leave the house and get a DUI (or worse), are we liable?

If there is any reason to come onto the property which gives them an excuse/probable cause, they will show up. It could be too many cars parked on the road, noise, tip of kids drinking. If they do show up and kids are caught in possession of alcohol, or smel like it , or act like they are under the influence, they will be charged with underage drinking and will be subject to driver license suspensions. I am not sure of criminal liability extending to parents in VA. IF any of these kids hurt someone or themselves or anyone else, you as parents could be liable and lose everything you have in a civil suit.
