QUESTION

Motion to Dismiss Violation of Speedy Trial

Asked on Sep 23rd, 2015 on DUI/DWI - New Jersey
More details to this question:
10/27/14 - i was arrested for DWI. 9/21/15 Trial. I'm disabled and have a mental illness. I've been on SSD since 2013. I'm very low income, on Food Stamps and have a housing voucher through my county's Mental Health Assoc. Because of the prosecutions delays I spent almost a year in fear of going to jail. If I did, I would lose my housing voucher and be homeless and my SSD would be suspended. This caused my mental health and physical well being to deteriorate. Can a Motion in Violation of Speedy Trial be filed after I agreed to a plea arrangement that kept me out of jail but I had to plead Guilty to the DWI?BTW the last adjournment was by the Judge who said he had to babysit his Grandson, didn't want to hit traffic and be late. This was mid trial. That cost me $600 bc my expert was there to testify. The one before that was by the prosecutor. That cost me $600 bc my expert didn't testify. There r other extenuating circumstances as well.

You accepted the agreement in open court and on the record. The agreement would be most difficult to undue.
