My friend is worrying about

More details to this question:
Him being 16 and his girl friend being 15. But when he had sex with her she was 14, and thinks she might be pregnant. Can he still go to jail if he is 16 and she is 15 or.he had sex with her when she was 14? They have know each other and went out like for two years...

there is not a simple answer. the statute requires a four year difference in age for there to be a violation of the 'sexual assault statute. however, one must be concerned with the 'endangering the welfare of child' statute which the prosecutor has the discretion to use if pressured by 'victim' and parents. the prosecutor has significant discretion to act in these situations.
