need an answer for a false DUI.

More details to this question:
My son was pulled over for not using a blinker. The officer asked if drinking. When told 1 beer, he was given the roadside tests. At 11pm the officer did not like the follow the finger test and he was charged DUI. Arrested, impounded car, then taken for a breath test. When he passed the test he said release me, but was told the charges were already given. Guilty first, then when proven innocent, was told to --tell it to the judge?? Was told by the police that even tho he passed the breath test, he COULD still be drunk. Why have tests if they are ignorded?

The test is only for alcohol. There is no test for drugs and the prosecution is relying upon the observations of the officer. We would have your son drug tested to demonstrate no use of drugs in the recent past. Please call. Ed Dimon 732-797-1600
