More details to this question:
I got a cell phone ticket for 39:4-97.3 and the office claimed he saw me talking to my phone. I was not even touching my phone nor was I talking to it. I can easily produce cell phone records to prove it (the talking part, I guess) that any time within a 4 hour before and after the ticket, there was no cellular activity. Is this enough to fight it? On my own? Or is a lawyer necessary?

I would obtain all the required records com the service provider. I would make sure that the records clearly supported your position. I would obtain the Discovery from the Prosecutor. i would show the Discovery and your cell records to an attorney. The attorney can negotiate with the Prosecutor or try the case if the Prosecutor will not dismiss. Ed Dimon 732-797-1600
