QUESTION

Should I get a lawyer?

Asked on Aug 16th, 2012 on Traffic Violations - Pennsylvania
More details to this question:
I was pulled over on 7-28-12 for doing 61mph in a 45mph zone. They system used was Enradd. I was not doing 61mph, although I have no proof other than my word. Estimated speed was 51mph. I pled NOT GUILTY to my citation and send in payment...fee plus court costs. My trial date was set for 9-13-12, but was continuted at my request till 9-24-12. Today, in the mail I rec''d a letter from DMV stating I was convicted of speeding on 8-8-12 and 4pts were assessed to my license. How could I be convicted if I haven''t even had my day in court? Is this considered a technicality? Based on this, can my case be dismissed or will this just be regarded as an error and corrected later?

You cannot rely on PennDOT to correct a mistake.  You might want to hire a lawyer to confirm that PennDOT will correct it, but otherwise you must be sure to file an appeal of the suspension with PennDOT or they very well may take the position that whether you were convicted or not does not matter since you did not appeal.  They are very difficult to deal with and you cannot count on justice prevailing.  Steve Steven F.
