5 yrs ago I was chraged w/ reatil theft only bcz I wasnt able to make the hearing at the magistrates office i need to expunge this record for employment and school reasons

You are eligible for expungement if five years have passed since you were convicted AND you have not been arrested since. Talk with a good lawyer to get some information about eligibility and the process. Read the expungement page on my website. Lots of people do this without a lawyer and end up making a mess of it - doing part of it right is like building part of a bridge - it doesn't accomplish anything.
