Asked on Feb 18th, 2021 on Criminal Law - Florida
More details to this question:
My sister switched tags of two products( meat) the value was about 35.00$ combined.. at a walmart store....While doing self check out she was asked by LP to go to a different cashier and they scanned all the products again. ..she had time to remove the tags from the products,.. so .LP could not probe the switch..although they asked her for the inconsistency.....they made her to pay the real price and asked her politely to NEVER use the aelf check out agaim....No ID was required and no police were called. She left the store with taht verbal warning. There is any chance that the store file a report to a police or send a letter. They only habe her credit card unformation.

If Walmart was going to prosecute her, it would have happened then and there. If she signed a trespss order from the store, she can't go back there, but short of that I don't think she has concern about a petit theft charge from this incident. I know times are difficult for lots of folks, and theft crimes have been on the increase since Covid, but there are resources available other than switching price tags on groceries.

Based on my experience where the alleged merchandise in question is released to the alleged perpetrator without being visualized by the police, no charges are ever filed.    There are reasons that they might have not filed charges. If they lost sight of her, then they were concerned that they could not state with any degree of certainty that it was the same meat that she changed the tag.   My advice-- do not shop at that Walmart again
