QUESTION

The district attorney on somerset county denied me

Asked on Feb 26th, 2020 on Parole and Probation - Pennsylvania
More details to this question:
So I have served my 2 years parole and 2 years or probation I have 1 year left my probation officer recommended early termination I have completed everything the judge asked paid off all fines and restitution and still can not get off. Is there anyway to file a motion to go in front of the judge and try to plead to why I should be off I tried calling the district attorney and his assistance said he would absolutely not change his mind. Then I ask why he wouldn’t even consider and they told me they didn’t have to tell me. So I told them I think it’s my legal right to know why and they put me on hold and then told me the reason is prosecutors discretion so at I screwed or is there any other way to fight it

Point of Law they really dont have to tell you.  It is their discretion.  Rarely, if ever, do they agree to early termination.  You can file a motion for early termination of probation.  If your probation officer is on your side and all your conditions are met a judge could very well terminate your case.  Your best plan is to contact an experienced local attorney.  They can help you draft your petition, and can also help present your case in the most favorable way
