Ticket for "Failure to Obey Traffic Signal

While driving to work, I approached an intersection where there is a traffic light. This morning, the light was not working at all and a series of traffic cones were set up along the center of the crossing road. I am assuming that these were set up to redirect traffic so traffic did not cross that road. Waited in a small line of cars that ALL went around the cones after waiting for traffic to clear on the crossing road, did the same thing by going around the cones to proceed straight across the intersection. I was subsequently pulled over and issued a summons that requires me to appear in court. Are traffic cones considered a traffic control device? I know that if a traffic signal is not working that you must treat it as a stop sign, which I did. The officer that issued the summons was parked near this intersection, I would assume to initially direct traffic, but instead was there to issue tickets.
