vehicle impounded on passenger with pot

More details to this question:
said vehicle is registered in my name. i was not in the vehicle at the time of the arrest / impoundment. charges are not written up yet nor received in the mail. how long can they keep my vehicle? Can they still impound the vehicle since I am not invovled in the arrest?
