Without knowing the facts of your case, any advice about your "odds of winning" would be pure speculation. .08 is the legal limit;; however understand that the DUI statute states that someone is under the influence of alcohol if their breath test is .08 or above, OR their ability to drive has been affected to an appreciable degree by their consumption of alcohol. This means that you could blow under a .08, but still be found guilty of DUI. Only way to know how best to handle your case is to review the case file. DUI cases are expensive, especially if the case goes to trial, but then again, a DUI conviction is even more expensive and can have very long term consequences. Hire an attorney.
