QUESTION

What are the chances I can get my probation ended early?

Asked on Jun 25th, 2014 on DUI/DWI - Michigan
More details to this question:
February, I got a DUI BAC .16. In April, I was sentenced to a year probation, a restricted license, one-time class, 2x weekly AA meetings, 2x weekly random alcohol testing, 2x monthly drug testing, along with continuing the therapy. Slow start with the AA meetings due to anxiety (could have proven by getting a doctors note). I had missed one testing. A lot has gone wrong in the first month, but since then, I have been fulfilling the requirements. I attended the class and provided proof. I have not missed a testing, I also have not tested positive. I am attending all AA meetings and therapy. If I pay off my fees ($400), how likely is it that I will be able to end my probation early? I know it's early to even think about this, but I'd rather pay a lot of money than have to drive to a testing facility on random days.

With an attorney arguing your motion for early termination, you have a shot. Depends on the Judge.

While it is certainly something that you can ask your probation officer, the likelihood of getting off early is not great, especially given your early violations. The probation period is basically a test, if you can get through the entire period of time, then you are basically "released".

Depends on the court and depends on what you mean by early; ten months instead of 12? maybe. Anything sooner? almost no chance, especially with the rocky start you described.

Impossible to say with any degree of certainty without knowing court, judge, po, etc. But since it hasn't been perfect probation so far my guess would be early termination is unlikely without a very, very good reason.

I don't know. It depends on Judge/probation officer. Sometimes my clients get off probation after serving half their time plus one month if everything is completed and fees/fines are paid.
