What are the consequences for retail theft first degree misdemeanor?

This is in Florida. The amount of the items is $80. This is the first time to be in trouble with the law.

You should get an attorney. Usually this crime is handled with a deferred prosecution agreement, whereby the Defendant pays fines and court costs, restitution, and completes a number of community service hours, then the is dropped. The Defendant would then want to get the records sealed and later expunged.

First, if the allegation is that the theft is for property under $100 then it is a second degree misdemeanor. The maximum punishment for a second degree misdemeanor is up to 60 days in jail or 6 months probation and a fine of up to $500. The maximum punishment for a first degree misdemeanor is up to 1 year in jail or probation and a fine of up tp $1, 000.
