If charged as a felony, it would be a class 6. If she has no prior felonies she would be probation eligible. Probation could be up to 3 years. However, a judge could sentence her up to 1 year in jail as a term of probation. Or the judge could sentence her anywhere from .33 - 2 years in prison.
