QUESTION

What are we looking at as far as punishment for a DUI probation violation?

Asked on Oct 19th, 2015 on DUI/DWI - Colorado
More details to this question:
My fiancé was arrested for DUI. This is his second one. Since then, he's been on probation, spent 16 days in jail, completed a DUI court mandated class, found a new job and started his community service, however, got pulled over for speeding. He found out his license was suspended but was reinstated the same day. He was not aware he had to report this to his probation officer. He went in today to see her and was handed a court summons for a probation revocation hearing. He will be done with his community service on Sunday, October 25th. His hearing is November 5th. His probation is done on November 2.

It sounds like your fiance has nearly completed everything. Keep that up. The new charges are probation violations. Getting them fixed the right way will solve the probation violation. For example, if charged with Driving Under Suspension, but only convicted of speeding or some other lesser charge, then likely no prob revo. Also, if fiance pleads guilty to a moving violation when he was suspended, it suspends him for a year even if the DUS is not a conviction. Beware.
