We are having problems with the public works dept in our town. They are deliberately piling snow in our driveway and behind our vehicles. We complained to them, instead of addressing the complaint they send the chief of police over. The officer is upset that this issue was dumped in his lap as it is not a police matter. He then goes on the tell us that we have vehicles that are unlicensed and he could write us a ticket and have the cars towed, when in fact these vehicles are legal and licensed. After the officer realizes this, he leaves the issue alone. Rather than address the issue he tries to scare us by pointing out violations that were not true. Two weeks later, snowplow driver deliberately pushes a mountain of snow in our driveway up against our car. My son tries to stop him and he laughs in his face and drives away. We complain at public works again. They send two drivers over to see what happened and to help with the situation. Once again, chief of police shows up and gives my son a ticket saying his vehicle is sticking too far out of the driveway, and if we donโt remove the snow he will tow our car. Since when is a citizen not allowed to complain to public works without police showing up getting involved and making a simple situation impossible? There is not one driveway in the neighborhood that has 6 ft of snow piled so high in and around it that there is no way to keep up with it. These drivers come back 2 days after it snowed and add additional snow behind our cars since we initially complained. What can we do about this? We are being issued one ticket after another because we have to park in the street due to this problem. There is a phone number to call and leave a message letting the police know that we are parking on the street overnight. We have done this and are still being issued tickets anyway. It is impossible to keep removing this snow with nowhere to put it when they have piled 6 ft on both sides of our driveway.
Get a lawyer and sue for a Civil Rights violation. Under 42 USCA Sec. 1943, if a governmental person acts "under color of State Authority to deprive you of your civil rights," that is actionable.
