Car accident on 1/1/2021. Me and other driver tried to deal with it outside of insurance/police. Negotiations fell through. Filed report/claim 10 days later. Insurances blamed eachother. Local police would not accept report because of length of time. I mailed a form to the state. Now on 1/29 I received 2 tickets in the mail. Careless driving and fleeing the scene. Both untrue. They were filed by the other driver not a police officer. I’m trying to file the same charges back but the municipal court is closed. Tomorrow is the 30th day. What can I do? Should I go Monday morning? Am I still able to file? Is there a different agency or place I’m able to file my complaint with before then? Should I file a police report with the local department and follow with my citizens complaint on Monday? Thank you.

These cases are fact sensitive. In addition, the law sets forth specific requirements about reporting to the police if there is property damage or if a person is hurt. In addition, the insurance company has reporting requirements. The court will want to see that all the missing requirements were fixed.
