QUESTION

What can I do if I am being charged with breaking and entering?

Asked on Mar 04th, 2013 on Criminal Law - Massachusetts
More details to this question:
I was crashing at this guy's place and got mad at me and locked me out. I had to break a window to get in and get my stuff. He filed a police report, saying I broke in and stole money from him ($300). All I took was my clothes.

If you did not steal then it is not a burglary. It may be an unlawful entry but you have a claim of right, that you were retrieving your property.

You did not have to break into his house to get your clothes. You should have asked him nicely or called the police to get your clothes back. Your public defender will probably get a trespass plea with 3 years probation.

What you can do is get an attorney, an experienced criminal defense attorney. Dont talk about this matter with others but you see if there are any other people that can testify for you that you were there before by permission and that was there during the argument and when you got kicked out etc. You get the idea. Get an attorney now.

Hire a lawyer, and do it before you open your mouth to the wrong folks and incriminate yourself further.

Based on what is written, you entered his home without his permission. I understand that your things were inside, but breaking in is not the legal way to obtain your things. Make sure you have a good lawyer.
