13 years ago when i was 15 years of age i was convicted of a crime that i did not do. when i went to court i didn't know what to do. the lawyer back then said if i plead innocent they were going to give me a six year sentence, but if i plead guilty they were going to give me a six month sentence and probation till i was 18. the crime i was accused of was, assault with a deadly weapon. this crime is not true. the only thing i did, i pushed a kid to the ground and that was it. the mother she told the police that i placed a broken bottle in the kid's neck. i have not done anything about this cause i was not aware of any laws i could do something. i need an advice that what could i do in this case. please help me! i was put away for 6 months for a crime i never did.
Enrique,
You should consult with an attorney who does 11.07 Writs to see if you might have a claim. Given the nature of the case that you pleaded to, that might be the best way for you to seek relief. You should understand that your situation is much more complicated than time permits here. Obtain a certified copy of your court file from the District Court in the county that your case arose out of and once you get a certified copy of the court's file, you should have an attorney review it.
Also, be aware that it would be better to have a phone discussion with an attorney than putting out all of the facts regarding your case on the internet as there could be issues of confidentiality that you might waive.
I hope this helps you in your situation.
