QUESTION

What can I do to help my son in his DUI case?

Asked on Aug 03rd, 2013 on DUI/DWI - Wisconsin
More details to this question:
My son was stopped for speeding, the policeman went through his car and did not find anything, then he made him take a breath test which was positive. The policeman changed the reason for stopping to careless driving and arrested him for DUI. He is 19. We paid an attorney $1000.00. His driverโ€™s license has been suspended 5months after the original arrest. He has gone for 2 court dates and the attorney postponed both times. He missed 2 days of work and he might lose his job because of the suspended license. The attorney never has time to call us back. He just keeps saying he is trying to change the plea to underage drinking. We had to tell his secretary that my sonโ€™s license was suspended. He had the letter in the file but had not addressed it. I canโ€™t afford to pay another attorney. We fill trapped and scared of what is going to happen. What do we do now? Please help.

You need to send the attorney a letter discharging him and requesting a refund.

Fire the attorney and get another. If you can't afford an attorney for your son, get a public defender. Get another opinion. Think about it This is your son's future, you may be penny sound and pound foolish. That is even though you save money now, you or more likely your son will be paying down the road. "If you think hiring a professional is expensive, try hiring an amateur." Red Adair. A good defense is never cheap and a cheap defense is never good. Has this attorney explained the critical needs license for under 21 offenders? If your lawyer isn't returning your phone calls. If he's making you wait in court for him to get discovery (ask if he's propounded discovery or looked at the maintenance/accuracy logs) or just to continue the case. He's probably not the best choice in attorney. Remember: at a misdemeanor DUI an attorney can appear on your (your son's) behalf. Your son does not need to be there.
