On May 2nd, 2013, I was sentenced to 24 months of probation, $500 fine, 50 hours community service, and DUI risk education/treatment classes. I just received a notice to appear at arraignment next week for violation of probation. I still owe over $1,200 in costs and fines but am in the process of completing DUI classes (I still have three weeks left) and have 24 hours left of community service. My father died suddenly in September and I had to take care of his funeral and burial without financial help. My daughter was born ten days later and so I was even further strapped for cash. Only this past month, have I been able to come up with money for classes (which I'm attending) and to pay for transportation to community service. My plan is to pay off the remainder of court costs when my income tax refund is deposited within the next two weeks. I am the primary caretaker of my children as my fiancé is the financial provider, therefore I am incredibly worried I could go to jail for VOP. What are my chances of being incarcerated?
You should hire a lawyer to go to court to recall the warrant. A lawyer can do this without you present, so it is less risky for you. With some luck the lawyer may be able to convince the Judge to reinstate you with no penalty.
