QUESTION

What can I do to stop harassment? How?

Asked on May 07th, 2015 on Criminal Law - Alabama
More details to this question:
My daughter is still being harassed by our neighbor even though we have a restraining order against them. We desperately want to move so that we can stop this harassment, but nobody is cooperating. Our leasing office will not move us into another apartment or let us out of our current lease. But my daughter is still being harassed and has even been hit and I need some sort of help.

First, you need to be more specific; some people use the word "harrassment" meaning anything from looking at someone the wrong way to assault. So, make notes as to the particulars as to what is going on. Next, document everything; dates, times, places, witnesses, photos, text messages, gather alll the info you can. Then, press charges for his violating the order of protection and demand that the landlord evict the guy; he is depriving you of your quiet enjoyment of the property, and by permitting that conduct, the landlord is violating the lease.

Contact the police to report the assault and battery as that is a crime. ?If they have violated the restraining order, tell the police as that also is a crime. ?Talk to the owner of the apartment complex and see if they will speak to the neighbors or not. point out to him/her that if the matter is not resolved, then the other tenant may stop paying rent because they are in jail and you might have no choice but to move out. ?It is cheaper for the owner to let you move to another vacant unit then face the possibility of one or two new vacancies.

You should have a stay away order as well as a typical protective order. Violations should be turned over to your police/sheriff AND evidence needs to be obtained and used to support prosecution. If you don't have evidence you need to be proactive to obtain it.

Violation of an anti-harassment injunction is a crime. Your daughter should notify law enforcement without delay. This is all the more so if the harassmnent has reached the point of a physical attack. Act right away.

If you have an injunction, document everything. Call the police. Then, take the neighbor back to court. With good evidence, the neighbor will either get fined, or go to jail, or both.

Go to the judge or magistrate that issued the restraining order and tell them that your neighbor is in violation. Also, consider going to the police and/or District Attorney. Good luck.
