What can I expect from a second dwi charge in the state of PA.?

More details to this question:
My step son has been charged with suspicion of a DWI. After a 9:00am fender bender accident, the officer smelled pot in his vehicle. He was taken and blood tested. He claims he had not smoked pot that day, but blood test revealed trace amounts from the day before. He was convicted of DUI 2 years ago, served time, payed fines and got his license back after a one year suspension. He has another conviction 4 years ago for drug parafenelia. sp? What will happen to him if he faces charges in PA? What will happen if he does not face the charges and moves to Florida?

Unless you go through the VERY lengthy and expensive process of a constitutional challenge he is likely to be convicted as Pennsylvania tolerates almost no signs of marihuana in blood.  For a second offense he is likely to face 90 days in jail, an 18 month license suspension, and other penalties if convicted.  Learn about DUI defenses and the other penalties here: http://fairlielaw.net/practice-areas/dui/
