QUESTION

What can one do about illegal criminal background checks?

Asked on Aug 01st, 2013 on Criminal Law - Michigan
More details to this question:
My ex wife for 9 years has been running checks on me and my family through the police department computer. She is a civilian employee for the department as a 911 dispatcher she is not a records dispatcher for officers that conduct stops. I have never been arrested or been in jail. This has been going on for years now. My ex wife even does back ground checks of other family members. This has become out of control and I moved out of the city limits to avoid the situation. I feel as if I have no personal life because my ex wife seems to know where I live and knows when the police have come to my home because of other incidents that happen in my area or my family’s area of residence. I received Facebook messages from her advising me of the call history at my address or my family. I've thought of going to the internal affairs division of this agency to file a complaint about this incident but fear that the department will not take action because of her being an employee of the agency. My ex wife had an affair with coworker from the same department. I'm seeking some legal advice on what I can do to make this stop. Any information would be helpful thank you.

You should make a complaint about the abuse of power to her superiors or the local elected officials. That may stop this or change her ways or get her fired, or not. It will not charge her personality or proclivities. You may also consider personal protection order.

The police will take action, they have in the past. Talk to the captain, Internal Affairs, and her superiors. Retain a lawyer if hey will not take action. We would get around $300 to handle this at most, maybe less.
