QUESTION

What do i do about a pending DWI case?

Asked on May 12th, 2012 on Criminal Law - Texas
More details to this question:
I was arrested in Texas for DWI 8/29/03. My attorney that I retained informed me that they would keep extending the case and it would drop off. Obviously it is still pending and I have to return to Texas. On 10/15/04 I was arrested and charged with DUI in Utah. The one in Texas is still pending. Am I facing a second DUI charge when I return to Texas or a first time offense? I have missed out on two jobs because of background checks because of the pending DWI in Texas.

9 years. You really need to look at hiring an attorney who will do something about your case. As for Utah, it can't be a second DWI, since there is no conviction at the time of arrest. So you have 2 First DWIs pending, and worst case scenario, you would get convicted of 2 firsts.
