QUESTION
What do I do on a first DUI charge in Colorado?

More details to this question:
This past Thursday I did an extremely foolish thing and drove somewhat intoxicated. This did result in my first DUI. I am very scared and do not know what to expect. My record has always been clean. I consider myself as a good citizen. The officer who arrested me manhandled me pretty badly because I was angry, scared and of never having anything like this happen I certainly did not know what to think or expect. I did refuse a test because of the way I was physically treated, which of course made me very angry and I felt violated. I literally have bruises from top to bottom. I know I did very wrong and feel so ashamed. As I mention, I have never been in trouble. I did apparently have a high alcohol level, which, tell you the truth, really surprised me. I am 51-years old, been going through menopause and I know for a fact from doctors that menopause really affects metabolism. I am not trying to make excuses, just stating a fact. I am scared about jail time. I have been searching the web for information and kept reading mixed messages. I know that I probably will lose my license for a time, but I financially really cannot afford to be out of a job. Obviously, if I cannot drive I cannot get to a job. I know and do truly admit that I messed up and I know this will never happen again. I am worried that because I refused an initial alcohol test that will really result in a problem for me. I had absolutely no idea that refusal initially was such a critical thing. It was not explained to be by the arresting officer just how critical that testing was. If I had known that, I would have certainly consented to a test. Thank for any advice or information regarding this very gloomy situation.

Considering what is at stake for you in regard to your job, and the fact that this is a refusal case, you REALLY need to consult with an experienced DUI defense attorney. There are many that offer free consultations. Good luck!
