My daughterโs father and I had an argument that went way too far. This is the first time anything like this has happened. He has no prior arrest or any criminal record or any history of violence in the 5 years we have been together. At the time, when the police were called there, I was irate. I didn't know that the charges that would be filed would be as serious as they were. I had a friend who was a witness and our daughter was in the apartment. I had some swelling on the side of my face and pictures were taken by the police. I'm not recanting my statement I'm wanting the charges to be dismissed because the consequences are so heavy they will have an everlasting effect on our child. I can barely make ends meet and I depend on his financial support to take care of our child paying for her child care. I don't feel threatened in any way and an order of protection is not needed. We both plan to attend some sort of counseling to get past this. Now I hate I even involved the police. I plan to sign a waiver of prosecution. I don't plan to flat out refuse to participate. I'm just asking that they dismiss these charges. A criminal record will make it hard for him to obtain gainful employment, or decent living arrangements. This affects our child as well. I'm willing to work with his attorney, the prosecutor or whoever I need to resolve this matter. No court date has been set yet.
You do not get to drop them. In Indiana, only the prosecutor gets to control whether criminal charges are filed. You may ask the prosecutor to do it, but you have no control over it.
