QUESTION

What do I do with multiple retail theft misdemeanor charges?

Asked on Nov 02nd, 2013 on Criminal Law - Georgia
More details to this question:
The past few months, I took some clothing items from a store. I got caught the other evening and spilled my guts on the previous thefts as well. As of right now, I have seven misdemeanor charges. I have no priors in theft or anything else except something back when I was a minor. What can I do to help the situation I'm in? I know I screwed up and even thanked the officers and the staff at the store for catching me. I want to make amends as well as figure out how to lessen the blow of this. Any advice would be most welcome.

Get a lawyer.? Get into counseling. Plead NOT guilty or you will lose all bargaining power. See if the lawyer can work out some sort of diversion for you so you end up with NO criminal record.? How are you ever going to get a job with a theft conviction?? What employer wants to hire a thief?

Retain a good criminal lawyer unless you are indigent. If you qualify the judge will appoint a public defender. You should know better than to steal from stores and you should never confess to the police or security if you are caught. You need to get a good education and work hard and study or you will end up in jail and have a criminal record that will make it very difficult to get a decent job for the rest of your life. You must make good decisions in life. You have made a lot of bad decisions and hopefully you are under 18 and can get Youthful Offender Status so you will not have a criminal record for theft crimes.

Petty theft is a crime of moral turpitude, and if convicted you can kiss your career aspirations goodbye. Multiple petty thefts is even worse, because the prosecutor can file a felony. Hire a lawyer before you get duped into a plea you will regret for life.

If you haven't already done so, secure counsel.

I would suggest retaining an experienced criminal attorney in your area that handles retail fraud or shoplifting cases, or at least consult with one. Normally, you would be eligible for a diversion program which would keep you from having a public record. However, with that many multiple charges, it is unlikely you are eligible or they would offer you that. Hopefully you can negotiate some type of deal such as pleading on one file and they will dismiss the others as long as you agree to pay restitution, if any is owed. Your attorney may be able to negotiate a no jail sentencing agreement and if you are between the ages of 17 and 21 you would be eligible to petition the court for HYTA status which would help you earn a non public record. A lot more information is needed before a more accurate answer can be given. That is why you need to consult with a retail fraud attorney in your area.

Each of the 7 counts is punishable by up to a year in jail and a $5,000.00 fine. So, you are looking at some substantial jail time if convicted. My advice: hire an attorney and get some counseling.
