QUESTION

What do I need to do?

Asked on Sep 13th, 2013 on Criminal Law - South Carolina
More details to this question:
I was convicted for drugs and now I am in prison. I hired an Attorney to file for me a Post Conviction Relief hearing in Common Pleas. My Attorney now works in the local Solicitor's office. Will he still be able to present me in Common Pleas with him working in the Solicitor's Office? He has been paid in full.

This answer does not create an attorney/client relationship.  You state you paid him in full, but you do not state the terms of the contract (what services were to be provided for what fee agreement).  If he now works in the Solicitor's Office, there would be a conflict of interest, but he is not entitled to keep a fee for any work that has not been done.  Please try to be more specific.  What did you pay the attorney to do for you?  What has he done?  Finally, he can not keep fees that go beyond the work done.
