What evidence is needed to file a Domestic Violence Restraining Order?

More details to this question:
I am 19 and currently living with my mother. The restraining order is against my brother. I want to move out but fear after constant threats if I try he will come after me.

Your testimony, witnesses, police report about the threats, etc. A lot depends on your credibility as a witness/victim.

Most Courts want to see at least 2 separate and distinct instances of violence or threats of immediate violence before they will grant a Personal Protection Order. Therefore, I would strongly recommend you keep a written log or journal, noting the exact date and approximate time of all his threats or violence. After he does it 2 or more times, go to Court and request the Personal Protection Order.
