What happens if two minors close in age are charged with statutory rape in California?

Hello, my daughter has been charged with statutory rape with a classmate who is very close in age with her 16 years old for both and 4 months apart. We initially reported this because he did some unwanted things to her but as the truth unraveled we found out 2 other incidents occurred where both times it was consensual implying that the third time was somewhat consensual. We then heard that some stuff that occurred during the 3rd incident was not consensual though. But the officer asked us today if we wanted to proceed with pressing charges and we both said no as he said many cases like these are usually dismissed. But somehow we still have a court show up date and they also would like us to turn in our daughters phone which I don't understand because this case will most likely be dropped due to the circumstances but if anyone knows, what is most likely going to happen with this case.
