What happens if you are caught having someone else start your vehicle using Ignition Interlock?

More details to this question:
My cousin has had a bad streak of DUIs and other legal troubles. While visiting for the holidays, my cousin's girlfriend started his car for him (he has one of those ignition interlocks on his car). As karma would have it, he got pulled over on the way home and the cop could smell alcohol. Is his girlfriend going to face charges for starting his car for him? Is he going to face charges for having someone else start his car for him?

She could face charges because she helped him commit a crime, for one thing. Not smart all to help him commit a new crime to get his probation revoked. He does not need new charges; his probation can be revoked for the new crime.

Well at the very least he will probably be violated on his probation and get some jail time and NO DRIVING PRIVILEGES. I am not sure that she will get in trouble but she is not any kind of friend by helping him to violate probation.

The answers to your two questions are: Yes, and yes. But there does not seem to be a lot of published authority from appellate decisions. It will be up to the prosecutor who reviews the police reports to determine what to charge, and IF to charge.
