QUESTION

What happens on a vc 23136(a) infraction?

Asked on Jan 18th, 2017 on DUI/DWI - California
More details to this question:
I was stopped on 01/01/16. I had a BAC of 0.01 but I was 18, now 19. It is not a DUI. I blew under the illegal limit. The only crime I committed was basically underage drinking. I know I can file an SR-22 and get my license back in a year after I pay my fines which sucks, but my main concern is my record. I'm a first year college student. I definitely have many goals set for myself, so I'm really scared. I have anxiety almost every day because of this situation. I formally haven't had any charges filed. I keep calling the court and they say that nothing has popped up in the system. The lady at traffic division said it would be handled at the criminal court since it is alcohol related but the lady at the criminal court said it would be handled at the traffic division since it is an infraction. Is this going take a toll on my future? Will it show up on background checks? Will jobs turn me away because of it? Do I check yes or no when applications ask about a criminal history? Should I have it expunged?

You should hire a lawyer and get this relatively minor charge dismissed. By yourself you may end up with a criminal record, and it isn't worth it (not to mention, if you did not request a DMV Hearing within 10 days, you will also lose your license for 1 year).
