QUESTION

What happens when charges are never filed?

Asked on May 12th, 2015 on Criminal Law - Pennsylvania
More details to this question:
I was arrested for marijuana March 30th. I obtained a lawyer the same week, and now he and I are waiting for a letter from the DA's office, giving us a court date. We've been waiting since then, and my attorney called yesterday saying it's still not showing up in the system for him. He thinks perhaps they spelled my name wrong. The officer told him he would file them within a week. He asked if I've received my letter from the DA's office. I've been waiting as well, but no, I have not received any mail such as this and therefore do not have a court date. The way my lawyer said it was "Well, maybe they spelled your name wrong, but, it's almost like, at this point maybe I'm almost kind of hoping they'll forget, but they never do. I don't want you to get comfortable and then 3-4 months down the road have those charges filed and the process started. I still have no received a letter. I think both him and I will come to the consensus that they will eventually get around to it. I don't think these things slip through the cracks. So either the officers haven't actually filed the charges, or my case is held up at the DA's office, correct? Just trying to seek advice. My attorney and I could wait and see, or we can square away the inevitable and get the process started so that overall it can finish sooner. The amount of time from arrest to file the charges is one year, correct? I may be completely wrong. Do we wait, or do I let my lawyer call the officers to ask what's happening?
