QUESTION

What happens when school prank goes wrong?

Asked on Jun 07th, 2013 on Criminal Law - California
More details to this question:
So my boyfriend and I went to his high school to do a senior prank. He went into the school and put flyers around the lockers then came back out. I know some of his other friends were outside doing other pranks. Now the cops are trying to say I was more involved than I was. Can they charge me with anything without any evidence I did anything? No one has seen me either. Also how much trouble could my boyfriend get into because he had no intent of harming the school in any way, shape or form. Thanks!

You don't tell me what the prank was or what the police are looking to charge. Without this info, I can't say. However, if charges are brought, because you were a knowing participant, you could also be charged.

Without knowing what the flyers said or how they were affixed to the lockers then I can't answer this question.

It's very difficult to give you a meaningful answer without more details. Passing out flyers doesn't sound like a crime (unless trespassing was involved) and "other pranks" could be anything. If any crimes were committed, then you could potentially face criminal liability if you aided and abetted the perpetrators. A common example of an aider and a better is a "getaway driver" or a "lookout". So, if you aided and abetted, you could be charged and potentially convicted of any crimes the perpetrators committed. My advice for you would be to not talk to law enforcement. Exercise your right to remain silent. If it seems like the cops are going to charge you with anything, you should hire a criminal defense lawyer immediately.

Yes they can charge you for the same crime the others committed. Someone has already given your name to the police. You need to learn your rights quick. # 1 - Remain Silent.? # 2 - ask for an attorney. The police will deny you an attorney on the basis you have not been arrested. This will confuse you. You will be tempted to make a statement that "I was there but I didn't do anything." Once you say that, you get charged. Remember and follow rule number 1. Also, don't be stupid. Have your parents hire an attorney for you now.

It would depend on exactly what was done and if there was any damage to the school. At the very least, you and your friends can be charged with trespassing, and, if there was any damage done, vandalism.
