QUESTION

What is an acceleration of a deferred sentence?

Asked on Feb 17th, 2015 on Criminal Law - Oklahoma
More details to this question:
My stepson's mother has been on drugs for some time and averages 3-4 arrests a year for different things, thus far they have all been misdemeanors. She finally caught a felony drug charge towards the middle of 2014, and she got a 2 year deferred sentence. Soon after she never showed up to set up payments or meet with the probation officer. They sent an application to accelerate her sentence for not doing the requirements. The D.A. has just issued a bench warrant and approved the acceleration. My question is what exactly does that mean? Will she now have to serve the 2 years that were deferred, or will she get a whole new trial for these charges? Thank you so much for your help.

If her deferred sentence is accelerated, ?she will actually receive a felony conviction. Whether she will have to serve all or some part of the two years is up to the judge. Her court costs due will also rise because of the motion to accelerate and the failure to appear. She definitely needs counsel.
