What is an out of state hold?

My friend was arrested and I would like to know what an โ€˜out of state holdโ€™ is.

It means there is a warrant out for his or her arrest in another state. This means that bail will usually be denied in Kansas. Or, if bail is posted, they will be transferred to the other state for legal proceedings there.

Generally, the term "hold" in this context refers to a court-order that would mandate that person's appearance at some location. It could mean that a court in another state or possibly a federal court has some type of warrant for his arrest.

It would be where another state is asking Michigan to hold someone pending the filing of extradition papers.

Did your friend have an outstanding warrant in another state such as New York? It is possible that they had a warrant for their arrest in one state, was arrested in another, the police saw that he had the outstanding warrant, and have now confined him pending extradition to the state where they had the pending charge.

It sounds like a warrant was issued by another state. That warrant acts as a "detainer" preventing your friend from being released until the other state comes to get him. He should be afforded an extradition hearing.

If a person has an out of state hold on his release this indicates that he has a warrant for his arrest in another state. He is being held for extradition to that state under the warrant.

A court 'out of state' has a hold on him. That is this court will not release him except to the other court until the matter in the other state is cleared up.

It means there is a Warrant from another state pending against your friend and the jail or prison is not going to let go of him until the other state either waives extradition or your friend agrees to go to the other state to answer those outstanding charges - or the passage of 90 days goes by and they haven't done anything to follow up on the matter. Then, usually this state will release him/her from jail, but they can always come back again looking for him/her. I suggest he hire a lawyer right away to contest the matter legally. Good luck.

When a Defendant is held in jail with an out-of-state hold, it usually means he/she has a warrant in that other state. The state that placed the hold will be notified and they must commence extradition proceedings (i.e. process and plan to extradite defendant from State A to State B). However, in some cases it may be unconstitutional to hold a defendant for too long without bail. Thus it is critically important to contact a New Mexico criminal defense lawyer who can immediately request a hearing to get the defendant out of jail.

That means there is a warrant from another state for his arrest. The other State has to apply to the governor to allow extradition and the other State has to come and pick him up. They have hearings to see if the State of Michigan will hold him to pick him up and if the other State will come and get him.

That means there he has some pending legal matter in another state. If he is in State A and State B has a hold on him for example, he cannot leave State A or be released on bail, etc. until State B either releases the hold or comes to get him after the other matter is resolved.

An out of state hold is when a person is arrested in another state, and that state then places a hold on the defendant until that State is done dealing with the issues it has with the defendant. Once that state is done, then that state releases the defendant to come back to your state, unless their might be holds by yet another state.

It means that when this state is done with him, another state is indicating he has something outstanding and not to release him here until the decision gets made about whether they will extradite him. He should consult a California lawyer first.

Essentially, he has a warrant/hold from another State. Basically, the State he was arrested in ran a background check and found that a different State has this hold. Therefore the jurisdiction that arrested him is required to hold him until the State that has the hold determines whether it is going to extradite him or your friend decides to waive extradition back to the state.

It basically means that the defendant has bench warranted or has a pending warrant in another state so that state has put a "hold" or detainer on the defendant so he cannot be bailed out of jail.

An "out-of-state hold" is a warrant or detainer of some kind from a jurisdiction outside of New York State. You would typically learn of an out-of-state hold at an arraignment, or at any other proceeding where bail is in issue. If nothing from New York is holding a defendant in jail, the defendant would continue to be held on an out-of-state hold (if one exists). New York would notify the holding jurisdiction that New York will release the defendant unless the holding jurisdiction obtains an extradition warrant. If the holding jurisdiction obtains an extradition warrant, New York would continue holding the defendant while extradition is litigated (sometimes for months). If the holding jurisdiction does not obtain an extradition warrant, the defendant would be released from jail (usually within a day or two after being released on the New York case).

That means your friend has another warrant out of state, so once he/she is done here in California, they may extradite him/her back to that state to deal with the warrant.

An out of state hold is a notation on a person's jail record that basically says 'do not release this person because they have a warrant in another state and that state must be given time to request extradition.' If the state waits five days after the person would ordinarily be released then the person will be released.

It probably means that he has a criminal complaint upon which an arrest warrant has been issued in another state which has been lodged as a detainer so that an effort to extradite him can be started keeping him in jail until the extradition effort is resolved.
