I was accused of smashing a car with a baseball bat/axe and pointing a handgun at two people (a couple). My accusers are both multiple felons who are going through a child abuse family court process and as of this time has had one child removed from their home due to abuse. The boyfriend was in violation of an EPO put on him by his girlfriend (my second accuser) when he called the police on me the night of this incident. He has also been caught lying in family court (one of many reasons his daughter has been removed from the home). His own biological daughter has written a statement for me stating that he is known to destroy his own property and make crazy assumptions (such as his girlfriend sleeping with her own father). I also have a statement from his neighbor claiming he heard no loud noises or commotion the night of this incident and also states he has witnessed my accuser destroying his own car (in the past) claiming it was "bugged". I am not friends with his neighbor but I did play a role (by calling Child Protective Services on him because he was making his 16 year old daughter sleep on the streets by kicking her out, making her get drunk with him because he doesn't want to drink alone, getting her high on pot and has busted her lip and I had seen the cuts and bruises.. all in her own words) in his daughter being taken away. I also have 3 active military personnel among other people who can verify my alibi that I was not even close to the general area on the night in question. I have a hotel receipt of where I was on the night in question, dated. I have a pawn receipt of my firearm (proving that my only weapon was in pawn at the time of this incident). Also, on the night in question, my accusers texted my brother's wife (who is the sister of my female accuser) blaming them for this incident (contradicting the complaint that they positively I.D'd me) and my sister in law (we aren't very close) replied that it "might have been (me)".
There is no way to get the case dismissed because you don't think that the government should prosecute you. You have to look at the evidence from the government's side; they have witnesses who said they saw you do it and they have damage to the car. I am not suggesting that this is a good case or that the evidence is strong against you; I am simply stating that I would not believe that a DA would dismiss the charges outright-no matter what you would tell them. They may offer a favorable plea option based on the shaky evidence, but not an outright dismissal. Your best possible outcome would most likely be to assert your right to a jury trial- let your peers decide.
