QUESTION

What is the consequence for the second DWI charge?

Asked on Jul 23rd, 2012 on Criminal Law - Florida
More details to this question:
My fiance was pulled over this weekend and got his 2nd DWI. He was vearing left onto a RD and was pulled over for crossing the yellow line. They did not breathalize him at the scene but did give him a field sobriety test. He also was not read his rights on the way to the station, or at all for that matter, where he was later breathalized and blew .20%. The reality is that this probably won't get dropped but what could it get reduced to?

It probably won't get reduced. He's facing Aggravated DWI because his blood alcohol was 0.18% or more. Stiffer fines. Longer revocation. Might get reduced to plain DWI.

Your fiance is an alcoholic and needs help. Driving is the least of his problems get him into counseling.
