Statute of limitations is probably not the correct term. The statute of limitations relates to the time period for the original filing of the charges, not necessarily the refiling. The statute of limitations will depend on the crime committed: for some crimes the statute of limitations is two years, for other offenses, it is five years. Some offenses have any even longer statute of limitation. Again, it depends upon the offense committed.
The answer to your question also depends on why the charges are being refiled. Were they withdrawn at some point or were they dismissed without prejudice by the Court? One implicates speedy trial and due process rights, while the other does not and falls back to being refiled within the statue of limitations.
