QUESTION

What recourse do I have with an expungement not handled correctly?

Asked on Oct 27th, 2012 on Expungements - Michigan
More details to this question:
I was arrested 10 years ago on a cultivation charge. I hired an attorney went thru pre-trial intervention and got an expungement. I received all documentation that I believed I needed. I was hired for a well-paying job with the city pending a criminal investigation. They called me in and told me because of that arrest I was not hired.

So who didn't handle the impingement correctly? you? Your attorney? Your company? Charges are NOT expunged on every database. The police have access to all past criminal activities. Find out where (what database) the company FOUND out this info then BACKTRACK to see what happened.

There is a difference between an arrest record, and an impingement of a conviction. You still have an arrest record which was picked up and tripped you. See an attorney about attempting to clear that from your record.

An expungment only gets rid of the conviction, it does get rid of the arrest reecord.
