QUESTION

What should I do after 2nd degree drug charges?

Asked on Jan 11th, 2013 on Criminal Law - Louisiana
More details to this question:
My boyfriend was locked up for a second degree felony charge, possession of weed near a school zone and public housing. This is his first charge. His bail once was $35,000 and now it is $25,000. They O.R. him in the middle of the night 2 weeks after his arrest. He's been out since the first week of October but has not received a court date. What might be the process? Or outcome?

He MUST have a lawyer or they will try to put him in prison. This is a serious offense.

Impossible to say. The DA could file misdemeanor charges, felony, or no charges at all. It depends in large part tot the kind of drugs involved, the amount, and other factors, as well as what criminal history he has. Unfortunately, they have up to the statute of limitations to file the charges, which in a misdemeanor is 1 year, and in a felony 3 years, generally. Unless you hire a lawyer to try to find out the status of the case, there's not much he can do but wait.

He should get an attorney and either fight the matter or work out a deal.

The court will mail him notice of an arraignment date. If he cannot afford an attorney, the Judge can appoint a lawyer for him.
