I have a hit and run case filed against me in the state of Georgia. There was only a moderate damage to the vehicle and no one was injured. I received a call from the police department yesterday asking me if I could come to their office to talk. What should I do?
DO NOT TALK TO THEM. They only want you to talk because even though they know it is your vehicle, they can't prove that YOU WERE DRIVING. Without your confession they can't prove their case.
You should retain a good criminal lawyer to handle the matter. He will talk to the police and insurance company. People should never talk to the police under any circumstances..or pull their own teeth either. Your lawyer will protect your rights and get you the best possible disposition.
This would apply to the State of Colorado. You do not have to help police investigate and build a case against you. The police cannot make you talk to them. Under the Fourth Amendment of the US Constitution, you have a right to remain silent, use it.
