What should I do with the DUI?

More details to this question:
I got pulled over for a license plate light being out and then was tested for a DUI where I blew a .07. I am not sure how I should plead to this or what to do. I can't afford a lawyer because I am a single father. I am really nervous. what should I do?

If you can't afford an attorney ask for the Public Defender. An .07 is below the statutory minimum however if the evidence shows impairment then you still can be convicted. Since no bad driving was observed that would be difficult. You should go to trial or have it reduced to a lesser offense.

At your 1st hearing, ask the court to appoint a public defender to represent you. With a .07 BAC level, your attorney may be able to have the charges reduced to a wet or dry reckless.

You should consult with a local DUI attorney in your area as soon as possible. You could have defenses to the charges available to you. It is not your burden to prove that you were not driving under the influence; but rather it's the government's burden to prove that you were. If there is a strong likelihood that they cannot meet that burden; you may consider exercising your right to a jury trial.

You need to hire a DUI specialist, who can probably get it dismissed given that you are at the borderline of the legal limit. Don't plead guilty!

You should plead not guilty. You were below the legal limit. If you cannot afford a lawyer, ask the judge to appoint one for you.

At your first court appearance, ask for a public defender, then plead not guilty. Your BAC is below the limit required for the presumption, and from you have said, there is no driving pattern on which to base a charge of DUI.

You are entitled to a court appointed attorney if you can't afford one. You really need an attorney, this is serious. If you have any kind of job you should shop for an attorney that will either let you use a credit card or will accept payments over time. A dui is serious business.

Go to court and plead not guilty. You lose all bargaining power if you plead guilty. Ask for an attorney if you can't afford one. Something should be able to be worked out.
