About 8 months ago, I was arrested for a DUI. I was parked on the side of the road with my hazards on waiting for my brother to arrive. My girlfriend was in the passenger. The keys were NOT in the ignition. An unmarked police vehicle pulled over and the end result was a DUI. This took place in a county 40 miles from my mailing address. I received an order to appear in court 8 months after the incident but did not get my mail until three weeks after it came. Now I have a warrant for my arrest. What should my next steps be?

Get a lawyer and go with that person to the court and get it straightened out.

You need to speak to a DUI defense attorney, if you haven't done anything, your license may be suspended and bench warrant is outstanding. A lawyer can help you figure out what you need to do, determine whether your license is suspended and what can be done to defend your case and get you lawfully driving.

He can also make arrangements for you to turn yourself in on the warrant and see if bail is available.

The first thing that needs to be done is to recall the warrant. A lawyer can go to court to recall the warrant without you present, so it is less risky for you. You have a goo case, not just because of a lack of driving, but also the difficulty to establish the time. But without a lawyer who knows DUI, it is hard to avoid a conviction.

Contact the court as soon as possible and explain to them why you did not make it to the court date. They should give you another court date so that you can move forward with resolving your charges.

Call the clerk of the court and see if you can get a new court date. Or you can turn yourself in on the failure to appear. Either way, the fact that the keys were not in the ignition is irrelevant.
