Asked on May 25th, 2015 on Criminal Law - Georgia
More details to this question:
After being found at fault for failing to yield in a left turn and hitting another car, I was found to be at fault for the crash. Then, upon searching my vehicle, officers found no marijuana but there was a smell emanating from my car so i got some sobriety tests that i failed. They gave me a marijuana DUI. What type of conviction am I looking at?

VC 23152(a), which has the same consequences as an alcohol DUI. But drug DUIs are harder to prove, since there is no statutory limit that deems a person "impaired" (like there is with alcohol). But by yourself there isn't much you can do. Time to shop for a DUI lawyer.

DUID (driving under the influence of drugs). This is similar to a DUI for alcohol. I strongly recommend that you hire an attorney to represent you immediately. If instead you just plead guilty, you will have a drug conviction on your permanent criminal record (and driving record), which will prevent you from getting a job, renting an apartment, getting federal student loans, or obtaining a regular bank loan.

First things first: consult a criminal defence lawyer, who can review all the facts with you in more depth than this site can do. Your penalties ought to be much the same as ordinary OWI (=DUI). A first offence usually does not carry jail timebut the fact you were in an accident makes the penalty harsher. (A second offence will be a misdemeanor.)

Is it a DWI? If so, hire a lawyer immediately as the state has many hoops to jump through in order to prove intoxication by pot. You may completely avoid a conviction.
