What will be the consequences for this DUI?

More details to this question:
My husband got a DUI in Texas blowing a .09, he has had 1 DUI in New Mexico a little over 5 years ago and had his lisence suspended. Do you think that this one will count as a second offense?

If New Mexico law is substantially similar to Texas law then they could charge him as a second. You need to hire an experienced DWI attorney that works in your area.
